Allergens Disclaimer

All products sold by Nantasket Sweets by Swedes Inc. may contain or come into contact with major allergens as defined by U.S. law. This includes, but is not limited to: peanuts, tree nuts, milk, eggs, wheat, soy, fish, shellfish, and sesame. Products may also contain or come into contact with other ingredients that could trigger allergic reactions, such as gluten, corn, coconut, seeds, artificial colors/flavors, and other food additives. Cross-contact may occur despite reasonable efforts to prevent it. Nantasket Sweets by Swedes Inc. does not guarantee that any product is free from allergens or other ingredients that could cause allergic reactions.

Choking Hazard Disclaimer

Candy and confectionery products may present a choking risk, particularly for young children. Candy is not recommended for children under 8 years of age. All children and non-adults should only consume these products under the supervision of a parent or legal guardian.

Products may vary in size, shape, design, or appearance. In rare cases, items may be irregular or misshapen. Such variations may increase the risk of choking.
All packaging materials — including plastic wraps, seals, labels, and shipping boxes — may also pose a choking or suffocation risk for children. Children must never handle or play with packaging materials unsupervised.

Packaging, sealing, and labeling are provided with reasonable care, but cannot eliminate all risks. By purchasing and consuming these products, the customer accepts all risks of choking or suffocation related to candy, irregular or misshapen pieces, and all associated packaging and shipping materials.

Overconsumption & Health Disclaimer

Excessive consumption of candy and confectionery products can present health risks. These include, but are not limited to: nausea, stomach upset, increased heart rate, increased blood pressure, tooth decay, obesity, diabetes, and other medical issues. Candy is intended for moderate, responsible enjoyment only. Consuming more than 5.5 ounces (156 grams) of candy in a single sitting, or within a short period, may increase these risks and is not recommended.

Dental Health Disclaimer

Candy and confectionery products contain sugar and other ingredients that may contribute to dental issues, such as cavities, tooth decay, gum disease, or other oral health problems. Hard candies, lollipops, and similar products may also pose a risk of damaging teeth. This includes, but is not limited to, cracking, breaking, or chipping. Eating hard candy is at the customer’s own risk. Regular brushing, flossing, and professional dental care are strongly recommended.

Foreign Objects & Contamination Disclaimer

All products are sourced from reputable manufacturers and packaged with reasonable care. However, Nantasket Sweets by Swedes Inc. does not manufacture these products and does not guarantee that they are completely free of foreign objects or unexpected contaminants. Foreign objects may include plastic, glass, or metal. In the rare event that a product appears to contain a foreign object, please stop consuming it immediately and contact us. Our responsibility is limited to replacement of the product or a refund of the purchase price, at our discretion.

Limitation of Liability

Nantasket Sweets by Swedes Inc., its owners, and employees shall not be liable for any indirect, incidental, or consequential damages. This includes issues related to consumption, misuse, allergic reactions, choking, dental issues, overconsumption, contamination, or product defects. In all cases, our liability shall be strictly limited to the total value of the order placed.

General Agreement

By placing an order through our webshop, the customer acknowledges and agrees to all of the above terms. This includes allergens, choking hazards (including irregular or misshapen candy and packaging materials), overconsumption, dental health, foreign objects or contamination, product variations, packaging and sealing risks, and the limitation of liability.

Transport & Delivery Time Disclaimer

All delivery and transport times provided on our webshop are estimates only. Actual delivery times may vary and are not guaranteed. Shipments may be delayed due to carrier performance, weather, internal delays, customs, or other factors beyond our control. By placing an order, the customer acknowledges and accepts that delivery times are not guaranteed.

Candy Shipping, Melt & Damage Disclaimer

Our candies may soften, melt, break, or become damaged during shipping. This risk is higher in warm weather or when products are exposed to handling in transit. We take care to pack orders securely, but we cannot guarantee that products will arrive in perfect condition. By placing an order, the customer acknowledges and accepts that the risk of melting, damage, or delays rests with them. Refunds or replacements will not be issued for candy affected by heat or transport-related damage.

 

Accuracy of Hand-Packed Orders/ less candy delivered than you paid for disclaimer

At Nantasket Sweets by Swedes, every order is hand-packed with care, precision, and a sprinkle of Swedish sweetness. While we always strive to match the exact weight and value of your chosen candy, small discrepancies may occasionally occur since each selection is picked by hand especially for you. By placing an order, you acknowledge and agree that such minor variations may happen. In the rare case that your order contains less candy than paid for, your sole remedy shall be a refund equal to the value of the missing amount. Any such claim must be submitted within 10 days from the date of your order; claims made after this period are not valid. Approved refunds will be issued back to the original payment method normally within 14 days, but can take longer time. No further claims or actions may be brought beyond the value of the missing candy.

 

Delivery & Risk Disclaimer

Once an order has been dispatched and confirmed as delivered by the carrier, responsibility for the package transfers to the customer. We are not liable for loss, theft, or damage that occurs after the carrier has delivered the shipment to the address provided by the customer. The customer is solely responsible for providing a complete and accurate shipping address. Orders that are lost or undeliverable due to incorrect or incomplete address information are not eligible for refund or replacement. Any claims for missing or stolen packages after confirmed delivery must be addressed directly with the carrier.

Product Appearance Disclaimer

Product pictures shown on our webshop are for illustration purposes only. Actual products may differ in color, size, shape, or packaging. Variations are normal and may occur without prior notice due to manufacturing changes, supplier updates, or display settings.

Force Majeure

We are not liable for delays or non-delivery caused by events beyond our control. These events include, but are not limited to, natural disasters, strikes, pandemics, technical issues, government decisions, or transportation disruptions.

Privacy Policy

Limitation of Liability

Nantasket Sweets by Swedes Inc., its owners, and employees shall not be liable for any indirect, incidental, special, punitive, or consequential damages. This includes, without limitation, claims related to shipping, delivery, storage, product condition, contamination, allergens, choking, overconsumption, dental issues, product defects, misuse, modification, resale, or redistribution.

Nantasket Sweets by Swedes Inc. shall also not be liable for issues arising from improper storage, handling, or environmental exposure after delivery (including damage from heat, cold, humidity, or direct sunlight); errors, delays, or damages caused by carriers, couriers, third-party vendors, or resellers; inaccuracies or omissions in product labeling, ingredient information, or translations, with customers remaining responsible for reviewing labels before consumption; reactions to ingredients not classified as major allergens, including but not limited to sensitivities to food dyes, sweeteners, or flavorings; or products provided as free samples, gifts, or promotional items, which are subject to the same disclaimers and liability limitations as purchased products.

To the extent any direct damages are legally recoverable, such liability shall in all cases be strictly and exclusively limited to the total value of the order placed. Our liability, whether arising in contract, tort, warranty, statute, or any other legal theory, and for any matter whatsoever, shall never exceed this amount.

General Agreement

By placing an order through our webshop, the customer acknowledges and agrees to all of the above terms. This includes, but is not limited to, terms regarding transport and delivery times, product variations, melting or damage risks, shipping responsibilities, carrier handling, packaging and sealing risks, and all matters described in the limitation of liability clause.

The customer further acknowledges and agrees that Nantasket Sweets by Swedes Inc., including its owners and employees, shall bear no liability of any kind beyond what is expressly stated herein, and that in all cases such liability shall be strictly and exclusively limited to the total value of the order placed.
